The Habeas Citebook Ineffective Assistance of Counsel by Brandon Sample 20100101 Paperback Books Reviews
This is a very great book! I strongly recommend this book for prisoners with legal problems. It is a great resource!
"The Habeas Citebook" by Brandon Sample is a Godsend to all American prisoners appealing their criminal convictions based on the claim of ineffective assistance of counsel. Unlike attorneys, most prisoners do not have access to online or computer-based case law research services (e.g., Westlaw or LexisNexis). What they do have are antiquated law books, which don't provide much for legal research assistance.
"The Habeas Citebook," while not an electronic research service (it's a book, after all!), helps prisoners to locate positive case law for ineffective assistance of counsel claims. The book itself provides a number of functional tools to help save prison litigants hundreds of hours of legal research, some of which they literally couldn't do on their own.
The book is divided into 52 targeted chapters covering specific areas of ineffective assistance. These include many subcategories of the following
Failure to Investigate
Failure to Move
Trial Ineffectiveness
Conflict of Interest
Financial Conflicts
Conflicts Affecting Plea
Constructive Denial of Counsel
Denial of Continuance
Advise Concerning Plea, Going to Trial, or Preserving Rights
Misadvise
Guilty Plea Induced By Promise or Coercion
And many other topical areas.
While nothing can replace the services of a competent attorney when appealing a criminal conviction, many American prisoners can't afford skilled counsel. In fact, many can't afford an attorney at all. As such, they are left to file their habeas corpus pleadings pro se, on their own. For those who are stuck in this unenviable position, "The Habeas Citebook" is plainly essential reading. Without it, they might simply not have access to the case law needed to overturn or correct their convictions.
This gift was requested by my friend. He was very happy with it.
Sent this to an inmate. He is very happy with it. Has found a lot of appeal rulings that may be useful in his case.
Great book
Very useful research, one does not have to share all of the authors's political opinions and convictions, but legal research is very useful.
Excellent resource book. Well researched!
great info
